Batch merge causes DB constraint error

I'm not sure how to make a test case for this, but on our install at http://crm.fsf.org we very frequently get a "DB Constraint Error" when trying to use the Batch Merge functions on a group of individual contacts. Some of these contacts do have custom fields. After doing a few individual merges in that group, then Batch Merge will work without error.
