Required prices sets still required even when not active

We use price sets with active dates quite frequently for membership discounts. However, we have noticed that if we have a price set with the "required" checkbox set, it will fail to submit a membership payment even if the required price set date range isn't active.

This is easy to reproduce, create two price sets, one with a date range for the current week, and one with a date that starts when the first one ends. Check "required" for both of them, and then try and submit a form using that price set.
