Creating new smart group from search will add all contacts from search

When I search for contacts and select some of them from the list and want to add them to a new smart group, all the contacts in the list will be added, not only the 3 contacts I have selected.

Steps:

• go to Search/Find contacts and hit the Search button
• then select some of the contacts and choose the Actions / Group - create smart group option
• enter the name of the group, tick the Mailing list option when creating the smart group
• save the group
• go to the Contacts / Manage groups menu
• check the number of contacts in the group
  ---> all the contacts that turned up as a result in the search got added to the smart group

This seems to be a smart group specific issue, since when I have tried to export, or creating a simple group the correct amount of contacts got added.
