civicrm conflicts with phpids drupal module

on a drupal site

• run civicrm
• run http://drupal.org/project/phpids

when using civicrm (NOT as user1!) error:

Fatal error: Cannot redeclare class IDS_Init in /home/user/sites/all/modules/civicrm/packages/IDS/Init.php on line 48

do we have two php-ids instances that conflict?
the civicrm instance might check if class is already declared.
(of course both could do but my feeling is this way is better)

setting to critical because it blocks responsible admin of drupal site.
