In Custom Searche class Base error when no WHERE is used

When I create a custom search where CRM_Contact_Form_Search_Custom_Base.php is used, I get an error if I have no WHERE clause. Causesd by function sql in Base, where the word 'WHERE' is always attached to the select clause independent of the contents of $this->where
